2. General Provisions
These terms and conditions apply to all agreements between Milenst BV (trading under the name Grafzorg.be) and the customer regarding grave maintenance services. By using our services, you accept these terms. Milenst BV is a company under Belgian law, registered with the Crossroads Bank for Enterprises under number BE1011.071.778.
Definitions
- Milenst BV / Grafzorg: The service-providing party, established at Krommelei 1A, 2110 Wijnegem
- Customer: The natural or legal person entering into an agreement
- Services: All grave maintenance and care services provided
- Subscription: The periodic service provision according to the agreed schedule
3. Service Provision
Available Services
- Monthly and quarterly maintenance of graves
- Bouquet service and flower arrangements
- Seasonal decoration
- Photo report after every maintenance visit
- Special services for commemorative days
Execution
- Services are carried out according to the agreed schedule
- Weather conditions may affect execution
- In case of impediment, an alternative date is agreed
- Access to the cemetery is required
4. Prices and Payment
- All prices include VAT unless otherwise stated
- Prices may be adjusted annually, communicated 30 days in advance
- Subscriptions are invoiced annually in advance, payment within 30 days
- In the event of late payment, services may be suspended; collection costs are borne by the customer
5. Obligations of the Customer
- Provide correct information about grave location and access
- Communicate special wishes in good time
- Report changes to contact details
- Enable access to the cemetery
- Timely payment of invoices
- Treat our staff respectfully
6. Subscriptions
- Minimum term of 1 year, automatic renewal unless cancelled
- Cancellation at least 1 month before the expiry date
- Changes take effect from the next billing period; downgrades without refund
7. Right of Withdrawal and Cooling-Off Period
- Consumers have a right of withdrawal of 14 days after concluding the agreement
- The right of withdrawal lapses when the service has started with explicit consent
- In the event of timely withdrawal, amounts already paid are refunded
8. Liability
- We carry out services with care and craftsmanship
- Liability is limited to the value of the services performed
- No liability for damage caused by weather conditions or force majeure
- Excluded: indirect damage and lost profits
9. Complaints and Disputes
- Complaints must be reported in writing within 7 days of the service performed
- We respond within 5 working days
- Belgian law applies; the court of Antwerp has jurisdiction
- Consumers can turn to www.belmed.be or the European ODR platform (ec.europa.eu/odr)
10. Force Majeure
Milenst BV cannot be held liable in the event of force majeure: extreme weather conditions, natural disasters, pandemic, war, strikes, government measures or restricted access to cemeteries beyond our control.
11. Cancellation and Termination
- By the customer: in writing 1 month before the expiry date, no refund, services until the end of the term
- By Grafzorg: in the event of non-payment, impossibility of service provision or serious breach of contract, with a notice period of 1 month

13. Final Provisions
- These terms may be adjusted, communicated 30 days in advance
- The invalidity of a provision does not affect the rest
- Drawn up in accordance with Belgian legislation
